Perhaps in the future the game will track which ones you've built and limit you to only building one per game even if you lose control of it, which would remove the potential for exploit (at the cost of making legitimately losing control of a megastructure more devastating). If this system seems like it has the potential to be exploited, that is because it does. If you later happen to regain control of some or all of those dyson spheres that you built then you will not be able to start a new one, but you will be able to keep and benefit from all the ones you recover.
